Terms of Service

Acceptance

Use of the TurboIntrastat platform implies full acceptance of these Terms of Service, the Privacy Policy, and the Cookie Policy. The user declares to have read, understood, and accepted all conditions described herein before using the service. Registration on the platform entails acceptance of all the above-mentioned legal documents. TurboIntrastat reserves the right to update these Terms with 30 days advance notice, communicated via email and through an in-platform notification.

Service description

TurboIntrastat is a SaaS (Software as a Service) platform for automating Intrastat declarations using artificial intelligence. The service includes: document upload (invoices, shipping documents), automatic data extraction via AI with accuracy exceeding 95%, validation and file generation in official ADM formats (CSV02/CSV03). TurboIntrastat commits to a service availability target of 99.5% on an annual basis, excluding scheduled maintenance communicated at least 48 hours in advance.

User obligations

The user agrees to: use the service exclusively for lawful purposes in compliance with applicable regulations; not attempt reverse engineering, unauthorized system access, prompt injection, SQL injection, scraping, or DDoS attacks; maintain the security of login credentials and not share them with third parties; not use the platform to process data in violation of the GDPR or applicable regulations. Violations of these obligations are subject to the 7-level graduated enforcement scale set out in the Security Policy, providing proportional actions from rate limiting up to account termination and reporting to competent authorities.

Intellectual property

The software, AI algorithm, design, and all platform content are the exclusive property of TurboIntrastat. The user retains full ownership of their documents and data uploaded to the platform.

Limitation of liability

The service is provided "as is" without warranty of fitness for a particular purpose. TurboIntrastat liability is limited to the total subscription amount paid by the user in the 12 months preceding the claim. TurboIntrastat is not liable for errors in AI-generated output: the user is responsible for verifying Intrastat declarations before submission to the Customs and Monopolies Agency (ADM). TurboIntrastat is not liable for indirect, consequential, or lost profit damages. Liability is excluded for interruptions or malfunctions due to force majeure, including but not limited to: natural events, government actions, telecommunications network outages, and third-party cyberattacks.

Governing law

These Terms are governed by Italian law, in particular EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 (Privacy Code) as amended by Legislative Decree 101/2018. For any disputes, the court of the registered office of TurboIntrastat shall have exclusive jurisdiction. In case of violation of the Terms of Service or Security Policy, a 7-level graduated enforcement scale applies: from rate limiting (level 0) and CAPTCHA challenge (level 1), to formal warning (level 2), temporary lockout (level 3), temporary suspension (level 4), permanent suspension (level 5), account termination (level 6), up to reporting to competent authorities (level 7). In compliance with the Digital Services Act (Art. 17), the user has the right to appeal any enforcement decision within 6 months of notification, with the right to human review of the decision and the option for out-of-court dispute resolution.
